The Senate has a constitutional responsibility to conduct the impeachment trial of Department of Homeland Security (DHS) Secretary Alejandro Mayorkas for high crimes and misdemeanors.
Specifically, the House of Representatives found that Secretary Mayorkas has willfully and systemically refused to comply with the law, and has breached the public trust.
The evidence on both charges is clear, comprehensive, and compelling.The House’s vote to impeach the first sitting Cabinet official in American history demands action by the Senate.
Throughout its nearly year-long investigation that ultimately culminated in impeachment proceedings, the House Committee on Homeland Security conducted rigorous oversight into the causes, costs, and consequences of the unprecedented crisis at America’s borders.
This methodical approach led us—and the American people—to the inescapable conclusion that Secretary Mayorkas’ actions warranted impeachment.
The constitutional grounds for Secretary Mayorkas’ conviction and removal from office are well-founded, and the historical record is clear.
The Framers of our Constitution gave Congress this grave authority for scenarios where executive branch officials, who are responsible for executing the laws passed by Congress, instead choose to ignore those laws and substitute their judgment for ours.
Secretary Mayorkas’ assault on the separation of powers is an attack on our constitutional order, and effectively renders this division of governmental responsibility irrelevant if we do not act.
Despite the disastrous consequences of Secretary Mayorkas’ impeachable conduct, the Senate has failed to take any meaningful action.
Majority Leader Chuck Schumer refuses to take up H.R. 2, despite the legislation being an effective step toward ending the crisis, securing the border, and preserving our asylum system for those who most need it.
The Senate has utterly failed to meet the moment when it comes to ending this crisis and resolving the chaos at our borders. Conducting an impeachment trial represents a unique opportunity to correct course.
For three years, the American people have demanded a secure border, an end to this crisis, and accountability for those responsible.
Refusing to hold a trial and doing away with it by procedural vote or sending it to die in committee would be not only an abdication of the Senate’s constitutional responsibility to take this matter seriously, but an affront to the millions of Americans suffering from the fallout of the ongoing crisis.
It would also be a historical anomaly—in every previous impeachment that was sent to the Senate, the upper chamber conducted a trial, except in three cases where the impeached official resigned, and one which was dismissed on jurisdictional grounds.
Leader Schumer has no excuse—hold the trial, render a verdict, and hold Secretary Mayorkas accountable.

Since Joe Biden took office:
There have been OVER 9 MILLION illegal immigrant encounters nationwide.
There have been OVER 7.4 MILLION illegal immigrant encounters at our Southern Border.
There have been 1.8 million known gotaways who evaded U.S. Border Patrol.
Immigration judges have thrown out approximately 200,000 deportation cases because DHS did not file the required "Notice to Appear" (NTA) by the time of the scheduled hearing.
In February, there were 189,922 illegal immigrants encountered at the Southern Border.
February was the 36th straight month where monthly illegal immigrant encounters have been higher than even the highest month seen under President Trump.
An average of 5,000 illegal immigrants are being released into the U.S. every day.
Under Biden, over 340 of these individuals whose names appear on the terrorist watchlist were stopped trying to cross the Southern Border.
So far in FY24, there have been 69 individuals whose names appear on the terrorist watch list who have been stopped trying to enter the U.S. illegally between ports of entry at the Southern Border.
This total is more than the encounters in all FY17, FY18, FY19, FY20, FY21, and FY22 combined.
Over 20,000 Communist Chinese nationals have illegally crossed the Southern Border since FY24 began in October.
Communist Chinese nationals are exploiting Joe Biden’s failed Far Left open border policies at “record-breaking figures,” becoming “the fastest-growing demographic entering the country illegally.”
The surge in Communist Chinese nationals encountered at our Southern Border has raised serious concerns that the Chinese Communist Party (CCP) is exploiting the Biden border crisis for nefarious reasons.
Biden’s Far Left open border policies are to blame for this historic crisis.
There are OVER 60 instances of Joe Biden and his Administration taking actions that undermined our nation’s border security, including halting the construction of the border wall.
