  • Virginia Foxx
House Republicans are once again addressing the needs of hardworking Americans by countering the Far Left woke agenda of the Biden-Harris Administration. That is why today, House Republicans are bringing to the Floor legislation that establishes transparency in the Security and Exchange Commission (SEC) and guarantees students’ First Amendment rights in higher education.

MAKE NO MISTAKE: The Biden-Harris Administration’s atrocious Far Left woke policies threaten the values of every American. House Republicans will continue to fight for transparency and accountability for the American people.

  • Universities should not have policies and practices that unconstitutionally regulate the marketplace of ideas on their campuses. Too many universities and accreditors have abandoned their mission to equip students to discover truth and think for themselves. The End Woke Higher Education Act reverses this trend by upholding Americans’ constitutional rights and restoring viewpoint diversity throughout postsecondary education.
  • H.R. 3724, the End Woke Higher Education Act, incorporates two bills: Rep. Owens’ Accreditation for College Excellence Act and Rep. Williams’ Respecting the First Amendment on Campus Act.
    • Rep. Owens’ Accreditation for College Excellence Act, ensures colleges are not forced to commit to the principles of DEI to receive accreditation, also:
      • Ensures accreditors’ standards do not require, encourage, or coerce an institution to support or oppose specific partisan or political beliefs or viewpoints on social or political issues or support the disparate treatment of any individual or group;
      • Prohibits accreditors from assessing an institution’s commitment to any ideology, belief, or viewpoint for the purposes of receiving accreditation for Higher Education Act (HEA) funding;
      • Protects a college’s religious mission and a religious accreditor’s ability to require adherence with religious practices or codes of conduct; and
      • Ensures that an accreditor cannot require, encourage, or coerce an institution to violate any right protected by the Constitution.
    • Rep. Williams’ Respecting the First Amendment on Campus Act, ensures the full sweep of the First Amendment is adhered to by public college campuses, also:
      • Makes free speech on campus a condition of receiving Title IV funds under the HEA;
      • Ensures students are educated on their First Amendment rights;
      • Safeguards the freedoms of association and religion on campus;
      • Prohibits institutions from forcing students, faculty, or applicants to take political litmus tests; and
      • Requires all institutions to disclose annually First Amendment policies held by the institution.
FACTS ABOUT H.R. 4790 – The Prioritizing Economic Growth Over Woke Policies Act: (Courtesy of the House Committee on Financial Services):
  • The Biden-Harris Administration has prioritized non-material and unrelated environmental, social, and political issues over sound financial information, driving up the costs and administrative hurdles for companies in capital markets. As a result, the investments of hardworking Americans are underperforming.
  • This legislation will:
    • Bring meaningful changes to SEC disclosure regulations by ensuring companies are only required to disclose material information and requiring the SEC to publicly list and explain any non-material disclosure demands.
    • Establish a Public Company Advisory Committee within the SEC to enhance investor protection and market fairness.
    • Mandate an SEC study to assess the potential impact of the Corporate Sustainability Due Diligence Directive (CSDD) and Corporate Sustainability Reporting Directive (CSRD).
  • The bill is a compilation of four previously introduced bills, including:
    • H.R. 4168, the Mandatory Materiality Requirement Act, originally sponsored by Rep. Huizenga
    • H.R. 4628, a bill to amend the Securities Exchange Act of 1934 to require the Securities and Exchange Commission to disclose and report on non-material disclosure mandates, and for other purposes, originally sponsored by Rep. Alex Mooney (WV-02)
    • H.R. 4652, the Public Company Advisory Committee Act, originally sponsored by Rep. Frank Lucas (OK-03)
    • H.R. 4653, the Protecting U.S. Business Sovereignty Act, originally sponsored by Rep. Dan Meuser (PA-09)
