Bill Summary

S. 735 would amend the Omnibus Appropriations Act of 2009 (P.L. 111-8) to strike a provision that requires adoption incentive payments made to States this year by the Health and Human Services Department for adoptions in Fiscal Year 2008, to be made in same manner as such incentives were awarded in Fiscal Year 2008.

Background

On September 17, 2008, the House passed the Fostering Connections to Success and Increasing Adoptions Act, which increased incentive payments made by the federal government to states for each special needs child adopted. The bill became public law and increased the payment for children under the age of nine from $2,000 to $4,000 for each adoption, and increases the payment from $4,000 to $8,000 for children nine years and older. The program is administered by the Health and Human Services Department's Administration for Children and Families. The bill would strike a provision that requires adoption incentive payments made to States this year by the Health and Human Services Department for adoptions in Fiscal Year 2008, to be made in same manner as such incentives were awarded in Fiscal Year 2008. The bill allows states to receive higher payments approved by the Fostering Connections to Success and Increasing Adoptions Act for adoptions in Fiscal Year 2008 for which payments are made in Fiscal Year 2009.
