On Monday, May 7, 2012, the House is scheduled to consider S. 1302, a bill to authorize the Administrator of General Services to convey a parcel of real property in Tracy, California, to the City of Tracy, under a suspension of the rules requiring a two-thirds majority vote for approval. The bill was introduced on June 29, 2011, by Sen. Barbara Boxer (D-CA) and referred to the Committee on Oversight and Government Reform, which held a markup of the bill and ordered it to be reported by unanimous consent on April 29, 2012.
The bill would authorize the administrator of the General Services Administration (GSA) to offer to enter into a binding agreement with the city of Tracy, California, under which the administrator of GSA may convey to the city any reversionary interest retained by the United States in a specified parcel of land conveyed to the city for educational or recreational purposes and all other terms, conditions, reservations, and restrictions imposed in connection with the conveyance of such parcel.
S. 1302 would require the city to pay to the GSA no less than the appraised fair market value of the parcel, as determined by the GSA’s administrator pursuant to an appraisal, based on the highest and best use of the parcel. The bill would also make the city responsible for reimbursing the GSA for costs associated with the implementation of this Act, including the costs of each applicable appraisal and survey.
S. 1302 would require the net proceeds from such conveyance to be deposited into the Federal Buildings Fund and made available for expenditure for any lawful purpose consistent with the GSA’s administrator's authority. The bill would prohibit anything in this Act from affecting or limiting the application of or obligation to comply with any environmental law.
