S. 1289 is being considered under suspension of the rules, requiring a two-thirds vote for passage. The legislation was introduced by Sen. Sheldon Whitehouse (D-RI) on June 18, 2009.

S. 1289 amends federal law to allow foreign evidence requests (i.e. requests from foreign law enforcement agencies for evidence from a U.S. company, like a bank) to be processed through one U.S. Attorney's Office and district court. Currently, requests have to go through each court where evidence resides, which could be dozens of different places.

The Foreign Evidence Request Efficiency Act would allow foreign evidence requests to be handled centrally, by a single or more limited number of U.S. Attorneys offices as appropriate.
