The House is scheduled to consider H.R. 4165 on Tuesday, December 8, 2009, under suspension of the rules, requiring a two-thirds majority vote for passage. H.R. 4165 was introduced on December 1, 2009, by Rep. Rick Larson (D-WA) and referred to the Committee on Transportation and Infrastructure, which took no official action.

H.R. 4165 would extend the authority of the Secretary of the Army, through the Army Corps of Engineers, to accept and expend funds contributed by non-Federal public entities to expedite the processing of permits through 2010.  Under current law, that authority is set to expire on December 31, 2009.

 

The Army Corps of Engineers is currently permitted to accept funds from non-federal public entities to expedite the evaluation of permits under the Corps' jurisdiction, after providing public notice. The Corps is required to ensure that the use of such funding would not affect its impartial decision-making with regard to permits. The current-law was last extended, through 2009, by the Water Resources Development Act of 2007 (WRDA) and expires on December 31, 2009.
