The House is expected to consider H.R. 2546, on the House floor on Wednesday, May 19, 2010, under a motion to suspend the rules, requiring a two-thirds majority vote for passage. This legislation was introduced by Rep. John Boccieri (D-OH) on May 21, 2009.

H.R. 2546 would prevent a condominium association, cooperative association, or residential real estate management association from adopting or enforcing any policy, or entering into any agreement, that would restrict or prevent an association member from displaying a Service Flag on residential property within the association in which such member has a separate ownership interest or a right to exclusive possession or use.
The bill further provides that nothing in the Act shall be considered to permit any display or use inconsistent with: (1) any reasonable restriction pertaining to the time, place, or manner of displaying the flag necessary to protect a substantial interest of the condominium, cooperative, or residential real estate management association; or (2) any Department of Defense regulations regarding rules or customs pertaining to the proper display or use of the Service Flag.
